Photo & Media Licensing

Who owns the photos and videos?

Outside the Box Photography retains full ownership of all images, videos, and media content created during your session. When you purchase our services, you are granted a license to use the media content for the property listing and promotion of that property. The license expires when the property is sold or the listing has expired or been withdrawn. Whichever comes first.

Your license allows you to use the images and videos for marketing/promotion of your property or business, including MLS listings, websites, social media, and online advertising. The license expires when the property is sold or the listing has expired or been withdrawn. Whichever comes first.

No. All licenses are non-transferable. If a property changes ownership, the new owner must purchase their own license to use the media. This will be done between the Photographer and the new owner requesting to use images/media.

No. Selling, redistributing, sublicensing, or profiting from the media outside of direct property marketing is strictly prohibited. This includes uploading content to stock photo or video platforms. Disregard will result in direct violation of the Digital Millennium Copyright Act of 1998, 17 U.S.C. §512 © and may result in legal action.

Each party requiring use of the images/media must obtain their own license. Licensing fees are determined on a case-by-case basis. Contact us to discuss.

No. In Rhode Island, licensing fees are not subject to sales tax, as the charge is for the right to use the media—not the media itself.

Appointments & On-Site Policies

What is your cancellation policy?

Confirmed appointments canceled on the same day of the scheduled shoot are subject to a minimum $50 cancellation fee.

Yes. Edit requests for the post-production removal of clutter will result in additional charges. These charges are billed separately and have a 24-hour turnaround time.

No. In the event you will not be onsite for the shoot, we require unassisted access to the property (lockbox, Supra, code, key, etc.). For efficiency and safety, we recommend the property be vacant during the shoot.

No. Properties are photographed as-is. Please ensure the home is fully prepared before our arrival, as we do not move furniture or stage items.

Additional time spent on-site may result in additional fees. This is a case by case basis.

For 3D tours, floor plan scans, and major bundles, all people and pets must vacate the property during the shoot.

Weather-related rescheduling does not incur a fee. The decision to reschedule due to weather conditions is at the sole discretion of Outside the Box Photography.

Media Delivery, Backup & Storage

How long do you keep my media backed up?

We provide a 90-day backup of all delivered media using secure platforms such as Google Drive and Aryeo.

After 90 days, Outside the Box Photography is not responsible for backing up or storing your media.

Yes. We strongly recommend downloading and securely storing your files for long-term access and protection.

Payments & Billing

When is payment due?

Payment is due after the shoot and before images can be downloaded, unless prior arrangements have been made.

Clients with a payment method on file will be automatically billed upon delivery of finished media.

Yes. Any additional edits, upgrades, or services requested after the initial order will be billed separately.

Property Preparation Guidelines

What’s the most important step?

Declutter thoroughly. Clean floors, counters, and surfaces so your property looks bright, spacious, and photo-ready!

Remove vehicles from driveways and avoid parking directly in front of the property. When possible, park in a garage or further down the street.

Open all blinds, curtains, and drapes. Ensure windows are clean and free of smudges.

  • Clear countertops and sinks
  • Put away dishes, toiletries, towels, and cleaning supplies
  • Remove items attached to refrigerators
  • Make all beds
  • Tidy rooms and store clothing/laundry out of sight
  • Remove toys (child and pet), newspapers, magazines, and clutter from view

 Please remove pets, pet items, and keep people out of the photographer’s way during the session.

Outdoor preparation tips:

  • Mow and edge the lawn
  • Remove leaves
  • Remove hoses, tools, and trash bins from view
  • Clean pools and turn on water features if applicable
